근로소득지급확인서를 허위로 제출한 사례

○ 강○○과 정○○은 ’18년 귀속 장려금을 신청하면서 ○○회사로부터 각각 00백만 원의 급여를 받았다는 근로소득지급확인서를 제출하였음. ○ 관할세무서에서 ○○회사의 대표자에게 두 사람의 근무 내역을 확인한 결과, 대표자는 두 사람이 ○○회사에서 근무한 사실이 없다고 진술하였음. ○ 관할세무서는 근로장려세제 심사위원회를 개최하여 두 사람이 고의 또는 중대한 과실로 사실과 다르게 장려금을 신청한 것으로 보아 2년간의 환급제한을 결정하였음.

별거 중인 부부가 중복 신청하였으나 지급제외 된 사례

○ 남편과 별거 중인 이○○씨는 딸아이와 함께 살고 있어 홑벌이 가구 유형으로 근로장려금을 신청하였으나, 남편 또한 장려금을 신청한 사실을 알게 되었음. ○ 관할세무서로부터 법령상 혼인관계인 경우에는 배우자가 있는 것으로 보며, 배우자는 동일주소에 거주하지 않아도 가구원에 해당하여 1가구 내에서 부부가 중복 신청하였다는 안내를 받음. ○ 주소득자인 이○○씨와 남편의 총급여액 등을 합산하여 가구유형은 맞벌이 가구로 변경되었으며, 맞벌이 가구의 기준 소득금액(3,600만 원)을 초과하여 지급제외 됨.
